R5 Large Lot Residential

R5 Large Lot Residential Zone purpose is for residential housing in a rural setting, often adjacent to towns where as the RU4 Primary Production Small Lot Zone purpose is for small lot agricultural production.

Lands zoned R5 Large Lot Residential are planned not to have access to urban services and to accommodate ancillary activities such as on site sewer. They are also intended to support very low density residential development in a semi-rural setting.

R5 Zone Objectives

The zone objectives for the R5 Large Lot Residential zone have consolidated those used in the existing three LEP’s, align with the zone objectives provided in the Standard Instrument LEP and reflect the objectives for semi-urban lands established within Hilltops 2040 Local Strategic Planning Statement (LSPS).   The objectives within the Draft Hilltops LEP for the R5 Large Lot Residential Zone are:

  • To provide residential housing in a rural setting while preserving, and minimising impacts on, environmentally sensitive locations and scenic quality.
  • To ensure that large residential lots do not hinder the proper and orderly development of urban areas in the future.
  • To ensure that development in the area does not unreasonably increase the demand for public services of public facilities.
  • To minimise conflict between land uses within this zone and land uses within adjoining zones.

Land Uses

Permitted and Prohibited Land Uses

A majority of the changes in permissible land uses within the R5 Large Lot Residential zone relate to providing greater consistency in the use of the zone across Hilltops. However, additional changes have been proposed to respond to and reflect the latest NSW Government strategic policy directions and the outcomes of the development of Hilltops 2040 Local Strategic Planning Statement.

It is also to be noted that the changes proposed in the Draft Hilltops LEP to permissible land uses will only apply to new development where an application has been made after the new LEP is finalised and in operation.

Each zone in a Local Environmental Plan includes a land use table that lists:

  • what you can build without seeking consent from Council or the ‘Consent Authority’ for that land use,
  • what you can build after seeking and gaining consent from Council or the ‘Consent Authority’ for that land use,
  • what you may not build on land in this zone.

Proposed Changes

The overarching goal of the new Hilltops LEP is to consolidate and harmonise the land use controls between each of the existing LEPs currently in force in Hilltops. These were inherited by Hilltops Council at the date of its amalgamation.

The following section describes how each R5 Large Lot Residential zone currently in force in Hilltops will be changed to achieve this goal. 

Boorowa

From the Boorowa LEP, the R5 Large Lot Residential zone is proposed to have some significant changes relating to land use permissions (what you can and can’t use your land for) and the minimum lot size for a dwelling. The Draft Hilltops LEP proposes to remove the following land uses from the R5 Large Lot Residential zone compared to the version currently in force in the Boorowa LEP.

There are no proposed changes to the current R5 boundaries in and around the township of Boorowa.

Land Use Changes

Removed for being inconsistent with the objectives of this zone

Advertising structures; Environmental facilities; Farm buildings; Farm stay accommodation; Port facilities; Public administration buildings; Recreation facilities (indoor); Recreation facilities (major); Recreation facilities (outdoor); Water recreation structures;

Please note: recreation facilities (indoor, major, and outdoor) usually receive their own dedicated zoning. That is why they are being removed from the R5 zone.

Removed for the sake of consistency across Hilltops

Attached dwellings; Boarding houses; Cemeteries; Centre-based child care facilities; Information and education facilities; Local distribution premises; Marinas; Mooring Pens; Moorings; Places of public worship; Recreation areas; Registered clubs; Semi-detached dwellings; Water storage facilities; Water treatment facilities;

Harden

From the Harden LEP, the R5 Large Lot Residential zone is proposed to have some significant changes relating to land use permissions (what you can and can’t use your land for) and the minimum lot size for a dwelling.

It is proposed to rezone the current RU4 Primary Production Small Lots land at Aurville to the northeast of Harden town centre to R5 Large Lot Residential, extending the existing R5 area.

Zone Boundaries

The RU4 Primary Production Small Lots zone at Aurville to the northeast of Harden town centre is proposed to be rezoned R5 Large Lot Residential. The red outline in the image below shows the extent of this zone extension.

Permissible Land Uses

The new Hilltops LEP 2021 proposes to remove the following land uses from the R5 Large Lot Residential zone compared to the version currently in force in the former Boorowa Shire area.

Young

From the Young LEP, R5 Large Lot Residential zones are proposed to have a general minimum lot size for a dwelling of 2 ha. This is the main change proposed that will affect property in this zone.

An Urban Release Area is being proposed which covers some R5 zones to the northeast of Young.

Zone Boundaries

Only very minor changes are proposed to the current R5 Zone boundaries in the former Young Shire. These are all minor boundary adjustments to replace inappropriate zoning along some gullies around Young township.

Permissible Land Uses

Minor changes in permissible land uses are proposed for R5 Large Lot Residential zones in the new Hilltops LEP compared to the current in-force Young LEP 2010.

The new Hilltops LEP 2021 proposes to remove the following land uses.

Removed for being inconsistent with the objectives of this zone

Exhibition villages.

Removed for the sake of consistency across Hilltops

Boat launching ramps; Residential care facilities.

 

Minimum Lot Size for a Dwelling

The purpose of the minimum lot size for a dwelling (MLS) control in R5 Large Lot Residential zones is to provide sufficient room to accommodate on-site sewerage sustainable over the long term and to minimise the potential for ‘land use conflict’ with surrounding agricultural areas. It also ensures appropriate sized parcels of land are available to fit the type of development sought in this zone.

The Draft LEP proposes Minimum Lot Size requirements in the R5 Large Lot Residential Zone which will be dependent on connectivity to reticulated water and/or sewer services. As a result, the following requirements are proposed:  
  • 1 hectare, if the consent authority is satisfied that each lot will be connected to Council’s reticulated water supply system; and
  • 2 hectares minimum if not connected to reticulated water and/or sewer services.
